However, the Assistant Commissioner, Ramanagara Sub- Division has issued an endorsement at Annexure-K stating that at present katha does not stand in the name of the vendor of the petitioner's grandfather and therefore it would not be permissible for the revenue authorities to consider the application filed by the petitioner. It is directed that the petitioner should approach a competent Civil Court to get a declaration of title. 3. This Court does not find any infirmity in the endorsement issued by the Assistant Commissioner.
