Instant writ petition has been preferred against the inaction on the part of revenue authorities in not recording the land bearing khasra no. 239/1 & 355/1 admeasuring area 0.876 hectare & 0.071 hectare situated at Village Dadgaon, in the name of petitioner in revenue records, in spite of order passed by the Sub-Divisional Officer (Revenue), Patharia as well as Commissioner, Bilaspur Division, Bilaspur. 2. Counsel for the petitioner submits that vide order dated 18.11.2024. Sub- AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2026.08.07 20:03:41 +0530 2 Divisional Officer (Revenue), Patharia, District Mungeli, Chhattisgarh had ordered for mutation in the name of petitioner with regard to the subject land. 3. Counsel for the petitioner further submits that in the pursuance of the said order of SDO (Revenue) Naib Tehsildar Patharia vide order dated 30.05.2025, had directed the Respondent No.3 to record the subject land in the name of the petitioner, pursuant to which, a memorandum dated 10.06.2025 was also issued to Respondent No.3 to comply with the order dated 30.05.2025 for recording the name of petitioner in respect of the subject land. He submits that despite of those direction, the name of the petitioner with regard to the subject land has not been mutated. 4. Having perused the documents on record , this Court finds that despite the order dated 18.11.2024 passed by the Sub-Divisional Officer (Revenue), Patharia, the consequential order dated 30.05.2025 passed by the Naib Tehsildar, Patharia, and the memorandum dated 10.06.2025 directing compliance thereof, the revenue authorities in specific Respondent No.3 has allegedly failed to carry out the mutation of the subject land in the name of the petitioner. If the aforesaid factual position is correct, the inaction on the part of the concerned revenue authority is not justified. 5. Accordingly, without expressing any opinion on the merits of the case, the present writ petition is disposed of directing Halka Patwari, PH No.3, Tahsil Patharia to consider and comply with the order dated 30.05.2025 and memorandum dated 10.06.2025 within seven days from the date of receipt of copy of this order. The Collector, Mungeli is directed to look into the matter and direct revenue authorities to do the needful. 6. Halka Patwari, PH No.3, Tahsil Patharia is also directed to send a 3 compliance report in this regard to Registrar (Judicial) of this Court within 10 days thereafter, failing which, appropriate action will be taken against the Patwari and necessary orders for suspension and disciplinary action will be passed against him.
