Accused no.3 in S.C.No.5080 of 2025 pending before the Court of IV Additional District & Sessions Judge, Tumakuru (Sitting at Madhugiri), arising out of Crime No.166 of 2025 registered by Koratagere Police Station, Tumakuru District, for offences punishable under Sections 61(2), 103(1), 115(2), 140, 238, 345(3) R/w Section 3(5) and 3(6) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.166 of 2025 was registered by Koratagere Police Station, Tumakuru District initially for offences punishable under Sections 103(1) and 238 of BNS, 2023 against unknown person, after the pieces of a human body was found by the first informant Jagadeesh B on 07.08.2025. During the course of investigation of the said case, Accused no. 3 was arrested on 10.08.2025 and remanded to - 3 - HC-KAR CNR: KAHC010321352026 NC: 2026:KHC:39377 CRL.P No. 6787 of 2026 judicial custody. After completing investigation, charge sheet is filed against three persons and petitioner herein is arraigned as accused no.3 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5023 of 2026 was rejected on 03.03.2026. Therefore, he is before the Court. 4. Deceased Lakshmidevi is the mother of CW2 - Tejasri, with whom accused no.1 was in a live-in-relationship. Since deceased was interfering with the relationship of the petitioner with CW2, he allegedly had a vengeance against her and therefore, he had conspired with accused no.2 and committed the murder of Lakshmidevi. Subsequently, accused no.3 was summoned to the property of accused no.2 and the dead body of deceased was cut into pieces and was packed in plastic bags. Thereafter, the plastic bags were disposed of in different places and after finding pieces of the dead body of Lakshmidevi, FIR was registered in the present case against unknown person. 5. Allegation as against the petitioner herein who is accused no.3 in the charge sheet is about assisting accused - 4 - HC-KAR CNR: KAHC010321352026 NC: 2026:KHC:39377 CRL.P No. 6787 of 2026 nos.1 and 2 to destroy the evidence and it is under these circumstances, charge sheet is filed against him for offences punishable under Section 238 & 61(2) r/w 3(6) of BNS, 2023. Investigation of the case is already completed and charge sheet has been filed. 6. Considering the nature of allegations found as against the petitioner, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. 7. Accordingly, the following: ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.5080 of 2025 pending before the Court of IV Additional District & Sessions Judge, Tumakuru (Sitting at Madhugiri), arising out of Crime No.166 of 2025 registered by Koratagere Police Station, Tumakuru District, for offences punishable under Sections 61(2), 103(1), 115(2), 140, 238, 345(3) R/w Section - 5 - HC-KAR CNR: KAHC010321352026 NC: 2026:KHC:39377 CRL.P No. 6787 of 2026 3(5) and 3(6) of BNS, 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
