1. Prayer for bail of the petitioners is taken up for consideration.
2. More than 160 kgs. of contraband Ganja was recovered from the possession of the petitioners.
3. It is submitted by the learned advocate for the petitioners that the petitioners have been in custody since October 19, 2025. Petitioners pray for bail on the ground of prolonged incarceration.
4. On the other hand, learned advocate for the State submits that commercial quantity of narcotic was recovered from the possession of the petitioners. The investigation of the case has already ended in a
2 chargesheet in the month of April, 2026. The case is fixed for consideration of charge in the month of August, 2026. He opposes the prayer for bail.
5. It transpires that more than 148.452 Kgs. of flowering and fruit tops of Ganja were recovered from the possession of the petitioners. The investigation of the case ended in a chargesheet and the trial of the case is yet to commence. The case is already fixed for consideration of charge in the month of August, 2026.
6. In such circumstances, I am not in a position to return a finding that the petitioners have been able to overcome the restrictions under Section 37 of the N.D.P.S. Act,
1985.
7. Consequently, the prayer for bail of the petitioners is rejected.
8. CRM(NDPS) 404 of 2026 is dismissed.
