Accused in Crime No.125 of 2026 registered by Huliyurudurga Police Station, Tumakuru District, for offences punishable under Sections 108 and 118(1) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned Additional State Public Prosecutor on behalf of the respondent - State. 3. FIR in Crime No.125 of 2026 was registered by Huliyurudurga Police Station, Tumakuru District for the aforesaid offences against the petitioner herein, based on the first information dated 22.06.2026, received from Sri Ajay K N, son of deceased Nanjaiah. In the said case, petitioner was arrested on 23.06.2026 and remanded to judicial custody. Bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.976 of 2026 was rejected on 09.07.2026. In the first information dated 22.06.2026 submitted by the son of the deceased, it is averred that, on 22.06.2026 at about 11.30 a.m, petitioner who came near the house of deceased allegedly had abused her and her husband for the reason that they had left their buffalo to graze in his property. When the deceased and her husband questioned the petitioner, he allegedly had assaulted them and asked the deceased - Smt. Sakamma to go and die. Subsequently, Smt. Sakamma had hanged herself inside her house and committed suicide. 5. Petitioner aged 41 years, who has no other criminal antecedents is in custody in the present case for the last more than one month. He is said to be an agriculturalist by avocation, having family. Considering the nature of allegations found against the petitioner and since major portion of investigation is already completed, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. 6. The petitioner is directed to be enlarged on bail in Crime No.125 of 2026 registered by Huliyurudurga Police Station, Tumakuru District, for offences punishable under Sections 108 and 118(1) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
