Since all these three intra Court appeals arise out of common impugned judgment dated 28.07.2026 passed by the learned Single Judge in WPS No. 2904 of 2025 and batch of writ petitions, they are clubbed and heard together and are being disposed of by this common order. 2. Heard Mr. Prateek Sharma, learned counsel for the appellants in WA No. 762 of 2026, Mr. Sunil Otwani, learned Senior Advocate assisted by Mr. Rohan Shukla, learned counsel for the appellants in WA No. 768 of 2026 and Mr. Manoj Paranjpe, learned Senior Advocate assisted by Mr. Arpan Verma, learned counsel for the appellants in WA No. 778 of 2026. Also heard Mr. Prasun Kumar Bhaduri, learned Deputy Advocate General, appearing for the 7 State, Mr. Rajkumar Gupta, learned counsel, appearing for respondent No.4, Mr. Sushil Dubey, learned counsel, appearing for respondent No.5 and Mr. Yashraj Verma, learned counsel, appearing for respondent No.6. 3. By way of the present writ appeals, filed under Section 2(1) of the Chhattisgarh High Court (Appeal to Division Bench) Act, 2006, the appellants, who were not arrayed as parties in the writ petitions, have challenged the common impugned judgment dated 28.07.2026 passed by the learned Single Judge in WPS No. 2904 of 2025 and the connected batch of writ petitions. By the said judgment, the writ petitions filed by the writ petitioners/respondents herein were allowed and the order dated 22.11.2024 (Annexure P-1), as well as the result published on 20.12.2017 (Annexure P-2), were quashed. The respondent authorities were, however, granted liberty to conduct the Chhattisgarh Subordinate Accounts Services (Departmental) Examination, Part-II, afresh after duly notifying the complete syllabus in accordance with the applicable Rules and Regulations. It was further directed that the revised syllabus be communicated to all eligible candidates well in advance of the examination so as to afford them adequate opportunity for preparation. 4. From a perusal of the impugned judgment and the materials available on record, it transpires that an advertisement was 8 issued on 27.04.2017 for conducting the Subordinate Accounts Service Departmental Examination, Part-II, which was scheduled to be held from 08.08.2017 to 14.08.2017. The same question papers were supplied to all the candidates, including the present appellants as well as the writ petitioners. The result of the said examination was declared on 20.12.2017, pursuant to which the selected candidates, including the present appellants, numbering 53 in all, were appointed vide order dated 20.12.2017 and have been continuously discharging their duties thereafter. It is also not in dispute that no interim order staying the operation of the result or the appointments of the selected candidates was granted in the writ proceedings. 5. It is further apparent that, despite the present appellants being the selected candidates under the result/select list dated 20.12.2017 and their appointments being directly and adversely affected by the relief sought and granted in the writ petitions, they were neither impleaded nor heard in the said proceedings. Ultimately, by the common impugned judgment dated 28.07.2026, the learned Single Judge quashed the order dated 22.11.2024 (Annexure P-1) as well as the result dated 20.12.2017 (Annexure P-2), thereby directly affecting the rights and interests of the present appellants, who had already been selected and appointed and had been discharging their duties for several years. 9 6. Having regard to the aforesaid facts and circumstances, particularly the fact that the present appellants were directly and substantially affected by the relief granted by the learned Single Judge, but were not impleaded as parties and were not afforded an opportunity of hearing, we are of the considered view that the grievance raised by the appellants requires consideration by the learned Single Judge in the first instance. 7. The appellants have an efficacious remedy of seeking review/recall of the common impugned judgment dated 28.07.2026 before the learned Single Judge on the ground, inter alia, that the judgment has been rendered affecting their vested and accrued rights without their being impleaded or heard in the writ proceedings. In such circumstances, and without expressing any opinion on the merits of the controversy raised in the writ petitions or on the validity of the impugned judgment, we deem it appropriate to dispose of the present writ appeals with liberty to the appellants to approach the learned Single Judge by filing appropriate review/recall petitions. 8. Accordingly, the present writ appeals are disposed of with liberty to the appellants to file appropriate review/recall petitions before the learned Single Judge seeking reconsideration of the common judgment dated 28.07.2026, particularly on the ground that they were not impleaded as parties to the writ proceedings despite being directly affected by the relief granted therein. 10 9. If such review/recall petitions are filed, the learned Single Judge shall consider the same in accordance with law, after affording due opportunity of hearing to all concerned parties. It is clarified that we have not expressed any opinion on the merits of the controversy involved in the writ petitions, and all questions in that regard are left open for consideration by the learned Single Judge.
