HON'BLE MR. JUSTICE GANESH RAM MEENA Order 28/04/2026
1. This anticipatory bail application under Section 482 B.N.S.S. has been filed by the petitioner in connection with F.I.R. No.486/2024, registered with the Police Station Kanota, District Jaipur City (East), for the offence punishable under Sections 8 and 20 of the NDPS Act.
2. Heard.
3. Considered the submissions made by the learned counsel for the petitioner as well as the learned Public Prosecutor and also perused the factual report submitted by the learned Public Prosecutor.
4. As per the contents of the F.I.R., during search, the contraband, Ganja, weighing 10.850 kg, was recovered from the possession of co-accused, Sonu Singh. In the statement of co- accused, Sonu Singh, he has deposed that he purchased the said
[2026:RJ-JP:18001] (2 of 2) [CRLMB-5593/2026] contraband from the present petitioner. It has been submitted by the learned Public Prosecutor that there is regular call conversation in between the accused-petitioner and co-accused, Sonu Singh, from whose possession the alleged contraband has been recovered.
5. Taking into consideration the overall facts and circumstances of the case and so also the statement of co- accused, which as per the settled law, cannot be discarded without there being any otherwise evidence and there is regular call conversation in between the petitioner and co-accused, which prima facie speaks of connectivity of the accused petitioner with the recovered contraband, this Court is not inclined to extend the benefit of anticipatory bail to the petitioner.
6. Accordingly, the present anticipatory bail application filed by the petitioner is dismissed.
