JUSTICE E.S.INDIRESH ORAL ORDER In the present writ petition, the petitioner has sought for quashing of the notification dated 03.01.2022 (Annexure-A). However, the learned counsel for the petitioner submitted that, he will confine his arguments only to Prayer (B) only in the writ petition. 2. Heard the learned counsel appearing for the parties. 3. Having regard to the submissions made by the learned counsel for the petitioner and upon careful consideration of the notification dated 03.01.2022 (Annexure-A), it is noticed that the private land in question has to be excluded from the purview of the notification issued for the purpose of providing unrecorded habitations in respect of the habitation - 4 - HC-KAR CNR: KAHC010630362025 NC: 2026:KHC:38162 WP No. 29375 of 2025 situated at Yeladabagi Village, Sira Taluk, Tumakuru District. 4. In that view of the matter, the petitioner has submitted a representation dated 04.11.2024 (Annexure-D) before respondent No.3, contending that the land in question is a private land and has to be excluded from the purview of the notification dated 03.01.2022 (Annexure-A). 5. Accordingly, respondent No.3 is directed to consider the representation dated 04.11.2024 (Annexure-D) and take an appropriate decision in accordance with law, within the outer limit of three months from the date of receipt of certified copy of this order. If, upon such consideration, respondent No.3 finds that the land claimed by the petitioner is outside the purview of the notification (Annexure-A), respondent No.3 shall direct respondent No.4 to enter - 5 - HC-KAR CNR: KAHC010630362025 NC: 2026:KHC:38162 WP No. 29375 of 2025 the name of the petitioner in the relevant revenue records, thereafter. 6. Till the consideration and disposal of the representation at Annexure-D by respondent No.3, the respondents are restrained from taking any coercive steps against the petitioner.
