The petitioners pray for pre-arrest bail in connection with Bhorer Alo Police Station Case No.195 of 2026 dated 15.06.2026 under Sections 308(2)/351(3)/3(5) of the B.N.S. 2023. It is submitted that the petitioners have been falsely implicated. 2. The de facto complainant alleged that the petitioners had taken some money from the beneficiaries of the Banglar Awas Yojana. 3. The learned advocate for the State opposes the prayer for anticipatory bail and submits that the persons from whom the petitioners had taken money, had complained to the de facto complainant and the de facto complainant lodged the FIR. One of the co-accused persons has stated that the petitioner no.1 had asked for Rs.10,000/- and she had paid Rs.5,000/- to the petitioner no.1. 4. However, considering the records, the statements of the witnesses, the nature of the complaint and the fact that the beneficiaries have 2 not made any allegation against the petitioners apart from one, prayer for anticipatory bail is allowed. 5. Accordingly, this Court directs that, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.20,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the B.N.S.S., 2023. The petitioners shall meet the investigating officer once a week and cooperate till conclusion of the investigation and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The petitioners shall not enter the jurisdiction of the Bhorer Alo Police Station, except for the purpose of meeting the investigating officer. 6. In case the petitioners fail to adhere to any of the conditions as stated above, anticipatory bail stands automatically cancelled without further reference to this Court. 7. The application for anticipatory bail is, thus, allowed and disposed of. 8. All the parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
