The petitioners pray for expeditious disposal of the of the application filed under Order 6 Rule 17 read with Section 151 of the Code of Civil Procedure, 1908 in Title Suit No. 238 of 2016, which is pending before the learned Civil Judge, Junior Division (1st), Jalpaiguri. 2. It is submitted that the prolong pendency of the instant case is causing hardship and harassment to the petitioners since on several occasions adjournments have been taken creating unnecessary delay in the hearing of the application filed by the petitioners for amendment of plaint under Order 6 Rule 17 read with Section 151 of the CPC. 3. The prayer of the petitioners is innocuous. Neither the parties stand to lose if a 2 proceeding is disposed of expeditiously. Infact such expeditious disposal shall enure to the benefit of the parties. 4. The revisional application is disposed of by requesting the learned Civil Judge (Junior Division (1st) at Jalpaiguri to decide the application filed under Order 6 Rule 17 read with Section 151 of the CPC upon giving adequate opportunities to the parties, without granting any unnecessary adjournment to either of the parties, strictly in accordance with law, peremptorily within a period of six months from the date of communication of this order. 5. This Court has not expressed any opinion on the merits of the suit and the application. 6. The learned Court shall proceed independently in accordance with law without being influenced with the observations made in the said order. 7. A copy of the revisional application along with the server copy of this order be served upon the opposite party and the learned advocate contesting the matter on behalf of the opposite party in the learned Court below within a week. 3 8. Affidavit of service to be filed before the Court below. 9. The revisional application stands disposed of. 10. There shall be no order as to costs. 11. Parties are to act on the server copy of this order. 12. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
