The petitioner prays for pre-arrest bail in connection with Pundibari Police Station Case No.375 of 2026 dated 23.05.2026 under Sections 126(2)/115(2)/117(2)/118(2)/109/351(2)/3(5) of the B.N.S. 2023. 2. It is submitted that the petitioner has been falsely implicated. The petitioner was the first husband of the victim. The petitioner contends to have suffered mental trauma after the victim was taken away from the petitioner’s house, without any formal divorce. The petitioner came to know that the victim had married again. He suffered a mental set back when he met the victim at the bazaar, there was an emotional outburst which led to an altercation between them. 3. The learned advocate for the State opposes the prayer for anticipatory bail and produces the case diary. 2 4. However, considering the nature of the injury and the contents of the complaint filed before the police and also considering the age of the petitioner, prayer for anticipatory bail is allowed. 5. Accordingly, this Court directs that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding to Section 482(2) of the B.N.S.S., 2023. The petitioner shall meet the investigating officer once a fortnight and cooperate till conclusion of the investigation and shall not intimidate witnesses or tamper with evidence in any manner whatsoever. The petitioner shall not try to establish contact with the victim. 6. In case the petitioner fails to adhere to any of the conditions as stated above, anticipatory bail stands automatically cancelled without further reference to this Court. 7. The application for anticipatory bail is, thus, allowed and disposed of. 8. All the parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.)
