For Petitioner(s): Mr.R.Balaguru Swamy For Respondent(s): Ms.Aswini Devi, Additional Government Pleader O R D E R W.M.P.No.14785 of 2026 filed seeking permission to the petitioners to join together and file a single writ petition is ordered on payment of separate court fee. 2.This Writ Petition has been filed challenging the impugned refusal check slip dated 11.03.2026 issued by the 3rd respondent, refusing to register the sale agreement dated 10.03.2026, presented by the petitioners for registration on the ground that there is discrepancy in the schedule to the said sale deed. 3.The petitioners have challenged the impugned refusal check slip on the ground of violation of Principles of natural justice and on the ground it is a non- speaking order with regard to the contentions of the petitioners as raised in this Writ Petition. 4.Ms.Aswini Devi, learned Additional Government Pleader, accepts notice on behalf of the respondents. __________ Page2 of 6 https://www.mhc.tn.gov.in/judis
WP No. 13533 of 2026 5.As seen from the impugned order, the contentions of the petitioners as raised in this Writ Petition have not been considered by the 3rd respondent. The petitioners were also not afforded any opportunity of hearing by the 3rd respondent, before issuing the impugned refusal check slip. 6.The petitioners categorically contends before this Court that by total non-application of mind, the impugned refusal check slip has been issued.
This Court is not expressing any opinion on the merits of the respective contentions. However, since the impugned order has been passed in violation of the Principles of natural justice and since the impugned order has not been considered, the said impugned order has to be quashed by this Court and the matter has to be remanded back to the 3rd respondent for fresh consideration on merits and in accordance with law. 7.Accordingly, the impugned refusal check slip dated 11.03.2026 issued by the 3rd respondent is hereby quashed and the matter is remanded back to the 3rd respondent for fresh consideration on merits and in accordance with law. The petitioners shall submit a written explanation to the 3rd respondent along with supporting documents as to why there is no legal impediment for the 3rd respondent to register the sale agreement dated 10.03.2026, presented by the __________ Page3 of 6 https://www.mhc.tn.gov.in/judis
WP No. 13533 of 2026 petitioner, within a period of one week from the date of receipt of a copy of this order. On receipt of the said written explanation and the supporting documents from the petitioners, the 3rd respondent, after giving due consideration to the written explanation submitted by the petitioners and the supporting documents produced by them, shall take a final decision as to whether the sale agreement dated 10.03.2026 presented by the petitioners can be registered or not, within a period of three weeks thereafter. In case the 3rd respondent decides to refuse the registration of the sale agreement dated 10.03.2026, the 3rd respondent shall pass a speaking order by giving due consideration to the written explanation submitted by the petitioners and the supporting documents produced by them. 8.With the above direction, the Writ Petition is disposed of. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
