Mishra, learned counsel for the petitioners. Also heard Mr. Sumit Singh, learned Deputy Advocate General, appearing for the State. 2. The present petition has been filed by the petitioners with the following prayer: “It is, therefore, most humbly and respectfully prayed that this Hon’ble Court may kindly be pleased to quash/set-aside the FIR in question, bearing No. 233 of 2026 dated 13.08.2026 for alleged commission of offence under Section 34, 420 of Indian Penal Code, 1860 registered in P.S. – Dharamjaigarh, District Raigarh, Chhattisgarh, in the interest of justice, equity and good conscience.” 3. The petitioner also filed I.A. No. 2 of 2026, application for grant of interim relief/state, with following prayer: “It is, therefore, most humbly and respectfully prayed that this Hon’ble Court may kindly be pleased to allow this application and further be pleased to stay the 3 effect and operation of questioned FIR with respect to the petitioners, bearing No. 233 of 2026 dated 13.08.2026 for alleged commission of offence under Section 34 and 420 of Indian Penal Code, 1860 registered in P.S. – Dharamjaigarh, District Raigarh (C.G.) (Annexure P/1), during the pendency of this instant petition, in the interest of justice, equity and good conscience.” 4. Upon perusal of the interim application, this Court finds that the petitioners have sought stay of the effect and operation of the questioned FIR during the pendency of the present petition, and no specific prayer for stay of arrest has been made therein. In view of the aforesaid, learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to file a fresh petition with appropriate prayer. 5. Learned State counsel has no objection to the prayer so made. 6. In view of the submissions made by learned counsel for the petitioners, the present petition is dismissed as withdrawn, with liberty to the petitioners to file a fresh petition with appropriate prayer, subject to payment of costs of Rs.5,000/- for having filed the petition in a casual manner and for not seeking appropriate interim relief in the application, thereby causing wastage of the valuable time of the Court. The aforesaid amount shall be deposited by the petitioners before the Registry of this Court, and the receipt thereof shall be produced at the time of filing the fresh petition, if any. The amount so deposited shall be transmitted to the Government Disabled College, Mana Camp, Raipur 4 (C.G.). Consequently, I.A. No. 2 of 2026 also stands disposed of. 7.
