The petitioner has sought for a Mandamus, directing the respondents 1 to 4 to construct a safety wall in between the stream/channel and road area and renovate the street running in Survey No.1033/10 in Anjugramam village, Agastheeswaram Taluk, Kanniyakumari District by considering the petitioner's representation dated 26.05.2026 and 30.05.2026 within a time frame. 2. The grievance of the petitioner is that the act of the authorities in not constructing the safety wall in between the stream/channel and road area will endanger the public safety. Hence, he seeks the above direction. 3. Learned counsel for the respondents 1 to 3, on instructions, would submit that though the work has been sanctioned, because of the objections raised by the private respondents that that have patta lands adjacent to the 2/4 https://www.mhc.tn.gov.in/judis W.P(MD)No.14894 of 2026 stream/channel, the authorities are not able to complete the work. He would further submit that the authorities will conduct survey within a week and proceed to complete the work. The said submission is placed on record. 4. Let the authorities conduct survey of the property in question within a week from the date of receipt of a copy of this order. If the survey reveals that the property in question belongs to the Government, then the private respondents have no right over the same and the work shall be completed within a period of one month thereafter with necessary police protection. The jurisdictional police is required to provide sufficient police protection if it is sought for by the authorities.
