Mr. Bhattacharjee, learned AGP, produces a copy of the order dated July 2, 2026 passed by the Additional District Magistrate (G) & Collector of Excise, Jalpaiguri rejecting the prayer of the 2 petitioner. By the said order liberty has also been granted to the petitioner to prefer an appeal before the Excise Commissioner, West Bengal in terms of the relevant notification. Since the representation has now been disposed of by an order dated July 2, 2026 and an appeal lies therefrom, nothing survives to be decided in this writ petition. Accordingly, the writ petition stands disposed of. Since the order dated July 2, 2026 is an appellable order, the petitioner is left free to work out his remedies in accordance with law.
