Accused in Crime No.41 of 2026 registered by Kodigehalli Police Station, Bengaluru City for offences punishable under Sections 75(2), 77, 78, 79, 351(2) & 352 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.41 of 2026 was registered by Kodigehalli Police Station, Bengaluru City for the aforesaid offences against the petitioner herein, based on the first information dated 28.01.2026 received from the victim girl, aged 23 years. In the said case, petitioner was arrested on 02.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5618 of 2026 which was rejected on 17.06.2026. Therefore, he is before this Court. 4. Perusal of the first information submitted by the victim girl, aged 23 years would go to show that, petitioner is acquainted to her and he had allegedly borrowed money from - 3 - HC-KAR CNR: KAHC010419052026 NC: 2026:KHC:38779 CRL.P No. 8945 of 2026 her mother Smt. Sujatha. In the first information it is stated that, the petitioner and Smt. Sujatha were friends and he was assisting Sujatha, who was suffering from blood cancer. It appears that, Smt. Sujatha had died in the month of September, 2024 and thereafter, petitioner was staying with the victim girl in a rented premises. 5. Allegation against the petitioner is that he had recorded private videos of the victim girl in his mobile phone when she was taking bath and also when she was in the toilet. It is further averred that, he had criminally intimidated the victim girl and had forwarded certain private videos of her to her mobile phone. 6. The petitioner aged 36 years is in custody in the present case for the last more than 1 month. Major portion of the investigation is completed. Considering the nature of allegation found in the first information as against the petitioner, who has no other criminal antecedents, his prayer for grant of regular bail needs to be answered affirmatively. 7. The petitioner is directed to be enlarged on bail in Crime No.41 of 2026 registered by Kodigehalli Police Station, Bengaluru City for offences punishable under Sections 75(2), 77, 78, 79, 351(2) & 352 of BNS, 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties (out of which one surety must be local surety) for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR CNR: KAHC010419052026 NC: 2026:KHC:38779 CRL.P No. 8945 of 2026 d) The petitioner shall not involve in similar offences in future.
