Laskar, learned counsel for the petitioners and Ms. S.H. Bora, learned APP, Assam, appearing for the State. Page No.# 2/3 2. This is an application for bail in respect of the petitioners, viz. (1) Jiauddin Ahmed, (2) Md. Taz Uddin and (3) Badar Uddin, who had been arrested on 03/02/2026 in connection with Duliajan P.S. case No. 12/2026 registered under sections 325, 3(5) of the BNSS, 2023 read with section 11(1)(a) of the Cruelty to Animals Act and section 13 of the Assam Cattle Preservation Act. 3. The brief of the allegation against the petitioners is that on 03/02/2026, the complainant lodged a written FIR before the concerned Police Station stating that on 03/02/2026 information was received from reliable source that beef meat has been stalking and selling illegally from the settlement area of Qtr. No. 1931 under Duliajan Police Station. 4. Accordingly, the Officer-in-Charge, Duliajan Police Station, made a General Diary entry vide the above-mentioned GDE No. Thereafter, the Officer-in-Charge of Duliajan and the Incharge of Bhadoi Panchali O.P., along with police station staff, proceeded to the said location. On arrival at Quarter No.1931, it was found that the owner of the said quarter is Taz Uddin, S/O Late Arfiz Ali, resident of Settlement Quarter No.1931, P.S. Duliajan, District Dibrugarh. I, along with police staff, conducted a search of the house premises in the presence of local witnesses. 5. During the search in the house of Taz Uddin, he was trying to fled away with a green-coloured plastic Gamla from his back door of the house. However, the Police team managed to apprehend him and recovered one green-coloured plastic Gamla contained in a 10 Kilogram (approx) of suspected beef. During the search, the following items were seized suspected beef (approximately 10 kg) contained in a green-colour plastic Gamla. During interrogation of Taz Uddin, S/O Late Arfiz Ali, admitted that his brothers namely Badar Uddin, Jiauddin Ahmed and Hobibur Rahman Munna, residents of near Duliajan Masjid, had purchased and stored the said meat items at his house for the purpose of selling, and that the meat was sold to various Page No.# 3/3 persons from their house. The recovered items were seized as per the seizure list in the presence witnesses and the entire seizure process was recorded on the e-Sakshya App. Hence the Case. 6. Having regard to the submissions of the learned counsel for the petitioners that another co-accused in the case, viz. Habibur Rahman has been granted interim pre-arrest bail in the case vide order dated 12/03/2026 passed in AB 526/2026 and also the fact that the petitioners have spent 50 days in custody as well as the nature of allegation, the prayer for bail is allowed. 7. The petitioners , viz. (1) Jiauddin Ahmed, (2) Md. Taz Uddin and (3) Badar Uddin shall be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two local sureties each of like amount to the satisfaction of the jurisdictional Magistrate, on the following conditions :- I) The petitioners shall participate in the trial and shall cooperate once the trial starts. II) The petitioners shall not try to intimidate the witnesses. 8. With the above observations, the bail application stands disposed of. JUDGE Comparing Assistant
