All these captioned writ petitions share a common background and involve the same issues, therefore, they were clubbed, heard together and are disposed of by this common order. 2. For the sake of convenience, Writ Petition (C) No. 1057 of 2023 is treated as the lead case for the purpose of disposing all the writ petitions. The petitioner in the said writ petition has prayed for the following reliefs :- 10.1 That, the Hon’ble Court may kindly be pleased to direct the respondent authority to allotment of that particular land under the Scheme of State Government to the petitioner. 10.2 Any other relief, which may deem fit, in the interest of justice.” 3. Succinctly stated, the facts of the case, as projected by the petitioners, are that the petitioners are aggrieved by the intimation letter dated 21.02.2023 issued by respondent No. 2, whereby he has been directed to remove the alleged unauthorized encroachment over the land within a period of seven days, failing which he would be forcibly evicted. The petitioner submits that he is running a small Dhaba on the said land for his livelihood and has been in possession thereof for the last 25 years. It is further contended that similar intimations have been issued to thousands of persons without mentioning any specific details of the land, 8 such as Khasra number, area, location, or any demarcation report, and the said intimation is merely a general format notice wherein only the name of the concerned person and his shop/house have been filled in. It is also contended that respondent No. 2, without taking any steps for rehabilitation of the petitioner and other similarly situated persons, has directed removal of the alleged encroachment within a period of seven days. Being aggrieved by the aforesaid action, the petitioner has approached this Court by way of the present petition. 4. Learned counsel for the petitioners submits that the petitioners are aggrieved by the action of the authorities in seeking removal of the alleged encroachment and prays for appropriate relief. It is submitted that the petitioners may be granted an opportunity to seek rehabilitation/settlement at an alternative place considering their long-standing occupation and livelihood concerns. 5. Learned counsel for the State has no objection to the prayer made by the counsel for the petitioners. 6. Having considered the submissions made by learned counsel for the parties and upon perusal of the record, this Court finds that there is no interim order of stay operating in favour of the petitioners. Further, the petitioners have admittedly encroached upon the Bilaspur–Raipur road, and such encroachment over a public road cannot be permitted to continue. Therefore, no relief can be granted to the petitioners in the present proceedings. 9 However, it is observed that, if the petitioners submit an appropriate application before the competent authority seeking settlement/rehabilitation at any alternative place, the concerned authority shall consider and decide the same in accordance with law. 7.
