Learned counsel for the applicant would submit that due to unavoidable reason, he could not appeared in the case when the matter was called for hearing on 25.06.2026 and the case has been dismissed for want of prosecution. He would further submit that the issue of proper and necessary party is involved in the claim case as the registered owner of the subject vehicle has died, and therefore, the claimants are prosecuting their claim case against the wife of the deceased. Since she is not the registered owner of the vehicle, she has no liability to pay the compensation and the person in whose possession the vehicle was has not been made as party non-applicant. 3. Considering the submissions made by learned counsel for the applicant and for the reasons mentioned in the application, the same is allowed and the WP227 No. 677/2026 is restored to its original number. 4.
