Learned advocate appearing for the petitioner submits that the petitioner is in custody for one and a half years and till date, out of 9 witnesses, 5 witnesses have been examined. It has also been claimed that the petitioner is the owner of the vehicle and has been unnecessarily implicated in the present case as the seizure was from an empty vehicle. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that six witnesses have been examined; three more witnesses are to be examined by the prosecution. Having regard to the advanced stage of the case, a last opportunity is granted to the prosecution. Prosecution would conclude the evidence of all its witnesses within a period of five months from the date of communication of this order.
2 If the evidence cannot be concluded in spite of cooperation extended by the present petitioner and all other accused persons, in that case learned Trial Court after the aforesaid time period is over, release the petitioner on bail on such terms and conditions as it deems fit and proper. At this stage, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1517 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
