This petition is filed seeking following reliefs: (a) To set aside the order dated 23rd May 2023 by the Ist Tribunal of Debt Recovery Tribunal, Bengaluru in D.No.1239/20 Annexure-L respect of schedule properties, and all further proceedings pursuant thereto, in the interest of justice, equity and law. (b) Grant such other reliefs which this Hon'ble Tribunal may deem fit to grant under the circumstances of the case, including the cost of these proceedings, in the interest of justice and equity. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the papers with care. 4. The DRT vide order dated 23.05.2023 passed final order. The law is settled that any person aggrieved by the order - 4 - HC-KAR CNR: KAHC010280602025 NC: 2026:KHC:38655 WP No. 14600 of 2025 of the DRT must file an appeal before DRAT. In the present case, the petitioners have not exhausted the statutory remedy and have invoked the writ jurisdiction. As there is an alternate remedy as contemplated under Section 18 of the SARFAESI Act to approach DRAT. This Court declines to exercise the discretionary power under writ jurisdiction. The petitioners may approach the appropriate forum, if so advised and if the law permits. 5. Accordingly, the writ petition is dismissed.
