1. The petitioner was awarded licence to run a liquor vend which was to operate from 30.03.2026 till 31.03.2027. According to the petitioner, the vend was situated on a road which became inaccessible on account of laying of sewer lines etc. Construction of road is also being undertaken, as per the petitioner. It is for this reason that the petitioner states that he does not wish to continue with the liquor vend and has already moved an application for surrendering his licence. The authorities have now sealed the liquor vend, and notice of cancellation has been issued to the petitioner. It is in this context that the petitioner is before us in the present petition.

Learned counsel for the petitioner states that the petitioner’s plea for surrender of licence ought to be considered first by the authorities, before proceeding any further, in view of the peculiar facts of the case.

representative of the petitioner has already appeared yesterday before the competent authority in cancellation proceedings, and the claim of the petitioner is being examined.

Once that be the position, we deem it appropriate to dispose of this petition with a direction upon the concerned authority i.e. respondent No.2 to accord consideration to the petitioner’s representation dated 29.06.2026 (Annexure P-10), by passing appropriate reasoned order in accordance with law. The proceedings initiated for cancellation etc. shall abide by the disposal of the petitioner’s pending representation.
5. We also provide that till such claim is dealt with by the competent authority by passing a reasoned order, no further coercive action would be taken against the petitioner. The sealing of the liquor vend shall remain subject to the orders to be ultimately passed by the competent authority.
