CRM-M-34864-2026 (O&M)
Date of decision:20.07.2026
Manoj
... Petitioner
Vs.
State of Haryana
... Respondent
CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA
Present: Mr. Kapish Singla, Advocate for the petitioner.
Mr. Neeraj Poswal, AAG, Haryana.
*** Manisha Batra, J. (Oral).
1.
The instant petition has been filed by the petitioner under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to him in case arising out of FIR No.308 dated 04.08.2025, registered under Sections 20(B)(II)(C) and 29 of the NDPS Act (offence under Section 238(B) of the BNS was added lateron), at Police Station Gohana City, District Sonipat.
2.
As per the allegations, on 04.08.2025, on the basis of a secret information, the petitioner was apprehended by a police party by conducting a raid and recovery of 01 kg and 105 grams of charas was effected from him. He failed to produce any valid permit or license for possessing the same. He was formally arrested. The recovered contraband was taken into possession. On his disclosure, co-accused Partap Singh @ Pardeep was nominated as PARVEEN SHARMA 2026.07.20 18:08 I attest to the accuracy and integrity of this document

-2- such. Some other co-accused were also nominated and arrested. Investigation now stands concluded.
3.
It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. A false recovery has been planted upon him. He is in custody since long. Co-accused Partap Singh, Gopal and Sunil have already been extended benefit of bail. He is not required for further investigation. The trial will take considerable time to conclude. His further incarceration would not serve any useful purpose. It is, therefore, argued that the petition deserves to be allowed.
4.
Per contra learned State counsel has argued that taking into
consideration the gravity of the allegations as levelled against the petitioner, he does not deserve to be extended the benefit of bail.
5.
This Court has heard the rival submissions made by learned counsel for the parties.
6.
The petitioner is alleged to have been found in conscious possession of commercial quantity of contraband. His antecedents are also not clean as he had previously been held guilty and convicted in a case registered under Section 25-A of the Arms Act. Rigors of Section 37 of the NDPS Act are attracted in this case. The trial has commenced and there is nothing on record to show that there would be any undue delay in the same. Taking into
consideration the antecedents of the petitioner, the commercial quantity of contraband recovered from him, the gravity of the allegations as levelled against him and the quantum of sentence which the conviction may entail and the attendant facts and circumstances of the case but without meaning to make PARVEEN SHARMA 2026.07.20 18:08 I attest to the accuracy and integrity of this document
