The petitioner has filed the present writ application challenging the impugned order dated May 8, 2026 wherein the respondent no. 2 has passed an order by discontinuing the firm in all the power utilities of the country for a period of five years including in power utility concerned where this act is found. By the said order, the respondent no. 2 has debarred the petitioner from supplying the materials for next five years. 2. The main grievance of the petitioner by challenging the impugned order is neither any show-cause notice was issued to the petitioner nor any personal hearing was provided to the petitioner and without giving any opportunity of hearing, the respondent has passed the impugned order by debarring the petitioner from supplying the materials for five years. 2 3. Learned counsel appearing for the authorities submits that before issuance of the impugned order, the show- cause notice was issued and the reply has been filed and after considering the reply, the impugned order is passed. Learned counsel for the authorities has handed over the copy of the show-cause notice dated January 21, 2026 wherein it is found that the show-cause notice was issued to the Universal Map Project and Engineering Service Limited not to the petitioner herein. The Universal Map Project and Engineering Service Limited has already filed the reply to the said show-cause notice. But the petitioner could not get any opportunity to file reply as he has not received any show-cause notice from the respondent authorities. 4. Considering the above, the impugned order dated May 8, 2026 is set aside and quashed by giving liberty to the respondent authorities, if the respondent authorities are intending to proceed against the petitioner, the respondent authorities shall issue show-cause notice to the petitioner, the petitioner shall be at liberty to file reply to the show-cause notice, if any, and after receipt of the reply, if any, opportunity of hearing should be provided to the petitioner and to pass appropriate order in accordance with law. 5. WPA 15789 of 2026 is disposed of. 6. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities. (Krishna Rao, J.)
