Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick … for the Petitioner(s) Mr. Ramashis Mukherjee Mr. Utsav Datta … for the State-respondent(s) Learned Senior advocate appearing for the petitioner submits that the petitioner is in custody since 1st January, 2026; charge-sheet has already been submitted before the learned jurisdictional court and there has been no recovery from the present petitioner. Learned Senior advocate also emphasizes that the petitioner has been implicated only on the basis of statement of a co-accused. Learned advocate for the State opposes the prayer for bail but is unable to substantiate any complicity regarding availability of the CDR and/or money trail. It has also been submitted on behalf of the State that although the spirit of the case diary reflects that there 2 are other cases but no specific case has been established either in the report or in the case diary. Having considered the locus of the present petitioner, although the seizure is of 10 kg of brown sugar in the instant case from the different accused, I am of the view that further custodial detention of the present petitioner is unwarranted in the facts and circumstances of the present case. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Safikul Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court (NDPS Act), 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Malda without prior permission of the learned Special Court/trial court. Accordingly, CRM (NDPS) 1080 of 2026 is allowed. Memo of evidence submitted be kept with the record.
