Complainant disclosed the facts to the IO that at the relevant time, he was resident of Village Gehri Baghi and was an agriculturist by profession. They were having 7.5 horse power electric motor connection in their fields. A 10 KW transformer was also installed in the fields. On 07.06.2026 at about 06.00 AM in the morning, complainant went to his fields to water paddy seedlings. When he went to the fields, he saw that the transformer installed therein was lying on the ground in a broken condition. All its parts were scattered. On close look, he came to know that some persons had committed the theft of copper wire from the transformer and also a starter motor had been stolen. He suspected that theft had been committed on the intervening night of 06/07.06.2026. Complainant tried to inquire about person who had committed theft and came to know that Satnam Singh son of Balveer Singh, Ajaib Singh @ Kaka (applicant) and Hardeep Singh alias Gobind Singh both sons of Sham Singh residents of Sukha Nand District Moga had committed the theft. After recording the above statement of the complainant, the FIR under Section 303(2), 324(4) BNS was registered. On the same day 27.06.2026, Satnam Singh son of Balveer Singh was arrested in this case.’ 3. Learned counsel for the petitioners submits that petitioners were innocent and had been falsely implicated. FIR was registered after unexplained delay of 20 days. Co-accused Satnam Singh had already been enlarged on regular bail. He further submits that statement of the complainant which formed the basis of FIR was hit by Section 55 BNS being hearsay and was not admissible. There were no direct allegation against the petitioners, therefore, petitioners deserved the concession of anticipatory bail. Learned counsel further submits that petitioner-Hardeep Singh was juvenile, his date of birth being 09.07.2007. 4. Notice of motion. 5. Petitioner-Hardeep was involved in two other cases and was a habitual offender. Learned State counsel further submits that as per Aadhar card, date of birth of petitioner- Hardeep Singh was 09.07.2007 and he completed the age of 18 years on 09.07.2025. He was thus not a juvenile in conflict with law. 6. The case pertains to theft of copper wire of transformer and starter motor, in the intervening night of 06-07.06.2026 from the fields of the complainant. Both petitioners have been named in the FIR. Allegations against the petitioners are specific. Their custodial interrogation is required for effecting recoveries. There are no extra ordinary circumstances made out to extend the benefit of anticipatory bail. Considering the nature and substance of allegations against the petitioners, it is not a fit case to release petitioners on anticipatory bail. Grant of anticipatory bail at this stage will not advance the course of justice and would amount to undue interference in the statutory investigational powers of the police, which is not permissible. 7. Dismissed. 8. Photocopy of this order be placed on the file of another connected case. All the pending miscellaneous applications, if any, stand disposed of.
