1. From the submission made on behalf of the petitioner it appears that petitioner is aggrieved since process relating to mutation of land in question is not complete. Though allegation is made against private respondents preventing petitioner in getting his land mutated but complaint lodged by the petitioner with the concerned police authority dated 18th June, 2026 reveals different story.
2. It appears from the complaint that petitioner made a prayer before the police authority for registration of FIR. Same prayer is made also in the writ petition for
2 registering a case and investigate the matter.
3. State respondents are represented by learned advocate.
4. There is an alternative remedy available to the petitioner under Section 175(3) BNSS 2023 in the event complaint of the petitioner is not transformed into an FIR.
5. In this regard reliance is placed on the
judgment of Hon’ble Supreme Court reported in 2007) 6 SCC 171 (Aleque Padamsee and Others vs. Union of India & Others).
6. In view of availability of alternative remedy writ petition is not entertained and same stands dismissed.
