The instant writ petition has been filed inter alia, praying for a direction upon the municipality to disburse the remaining portion of the bill raised by the petitioners in respect of the work order SL. No.3 of NIT No.351/PWD/ BMC dated 4th July, 2024 amounting to Rs.27,18,694/- along with security deposit and earnest money amounting to Rs.57,543/-. 2. Ms. Nandy, learned advocate representing the petitioners by drawing the attention of this Court to the work order dated 6th September, 2024 and the certificate issued by the Executive Engineer, Bidhannagar Municipal Corporation dated 26th May, 2025 would submit that the Executive Engineer of the municipality has already confirmed the execution and completion of the work at the instance of the petitioners for repairing and 2 WPA 7495 of 2026 renovation works of DC park within ward no.40 under Bidhannagar Municipal Corporation. Ms. Nandy has also drawn the attention of this Court to the reminder letter issued by the petitioners calling upon the municipal authorities to release the final bill amount. She submits that in the facts as stated above, the municipality should disburse the entire amount due and payable along with the security deposit and earnest money. 3. The municipality is represented and has placed before this Court a report dated 20th July, 2026 duly counter-signed by the Controller of Finance, Bidhannagar Municipal Corporation. Such report acknowledges the factum of the petitioners being issued work order, tender amount and the issuance of completion certificate dated 26th May, 2025. Learned advocate for the municipality would submit that although the work has been executed, taking into consideration that diverse payments are required to be made by the municipality to several contractors, this Court may be pleased to permit the municipality to make payment of the petitioners’ claim in six installments. 4. Having heard the learned advocates appearing for the respective parties and noting that the petitioners were entrusted with the job for improvement of municipal infrastructure as noted in the work order and the petitioners having completed such work should be disbursed their due entitlement. Since, the municipality has also acknowledged the execution of the work, I am of 3 WPA 7495 of 2026 the view that the municipality ought to disburse the admitted amount on an expeditious basis, in accordance with law, in four (4) equal monthly installments commencing on and from August, 2026. First of such installment should be disbursed on or before 10th August, 2026 and the succeeding installments should be disbursed on or before the 10th of each succeeding month until the entire payment is made. 5. With the above observations and directions, the writ petition is disposed of.
