CRM-M-30493-2026 (O&M) Date of decision: 20.07.2026
Jatin Salwan
...Petitioner
Versus Central Bureau of Investigation
...Respondent
CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA
Present:- Mr. Sandeep Sharma, Advocate
for the petitioner. Mr. Akashdeep Singh, Special Public Prosecutor
for the respondent-CBI. MANISHA BATRA, J. (Oral)
1. Prayer in this petition filed under Section 483 read with Section 528 of BNSS, 2023 is for grant of interim bail on medical grounds to the petitioner in case bearing No. PC-13 of 2025 titled Central Bureau of Investigation v. Jatin Salwan and another, arising out of FIR No. RC0052025A0015 dated 14.08.2025, registered under Sections 61(2) BNS and Section 7-A of the Prevention of Corruption Act, 1988, at Police Station CBI, ACB, Chandigarh, to enable him to undergo proper medical treatment. 2. As per the prosecution case, the aforementioned was registered on the basis of a written complaint submitted by one Harsimranjit Singh. The complainant alleged that the petitioner, who is an Advocate, had demanded illegal gratification of Rs.30 lakhs for procuring a favourable order from a judicial officer posted at Bathinda in a matrimonial dispute involving the complainant's cousin. The complaint was entrusted for verification by the CBI and, during the course of verification, the recorded conversations allegedly substantiated the allegations. alleged that the petitioner reiterated the demand of Rs.30 lakhs, insisted that the amount was non-negotiable and directed the complainant to first pay Rs.5 lakhs as token money, which was to be collected by another person on behalf of the concerned judicial officer. Finding prima facie commission of offences punishable under Section 61(2) BNS and Section 7-A of the Prevention of Corruption Act, 1988, the present FIR came to be registered against the petitioner and other unknown public/private persons. Investigation was thereafter completed and the final report under Section 193 BNSS was presented before the Special Court, where charges have already been framed and the prosecution evidence has commenced. 3. It is argued by learned counsel for the petitioner that he is a 70 year old person who has been in custody since 14.08.2025 and the investigation has already been completed.
It is submitted that the final report has been presented before the trial Court, charges have been framed and the trial has commenced. It is further argued that the present petition is confined to seeking interim bail on medical grounds as the petitioner is suffering from multiple serious ailments including Left Ventricular Diastolic Dysfunction (Grade-I), Mitral Regurgitation, Tricuspid Regurgitation, gastric ulcers, gastritis, fatty liver, asthma and other co- morbidities. It is argued that while in judicial custody, the petitioner has repeatedly been referred to Government Medical College and Hospital, Sector 32, Chandigarh on account of breathlessness, chest pain and numbness in the left arm. According to the medical records, the consulting Cardiologist has advised coronary angiography, subject to clearance from the Gastroenterology Department owing to the petitioner's long-standing history of peptic ulcer disease. Learned counsel further submits that despite repeated referrals, the advised coronary angiography MOHAMMAD WASEEM ANSARI 2026.07.20 14:02 I attest to the accuracy and integrity of this document

has remained pending for over six months due to the petitioner's multiple co- morbidities. The petitioner continues to suffer from severe abdominal pain, black stools and bleeding on account of gastric ulceration and that adequate specialised treatment cannot be effectively provided while he remains in judicial custody. The petitioner has deep roots in society and is not likely to abscond or misuse the concession of interim bail. Hence, it is urged that the petition deserves to be allowed and the petitioner deserves to be granted concession of regular bail. 4. Medical status report of the petitioner has been filed. Learned counsel for the respondent-CBI has opposed the prayer of the petitioner for interim bail. It is argued that the allegations against the petitioner pertain to a serious offence under the Prevention of Corruption Act involving demand of illegal gratification for influencing a judicial officer. The petitioner had earlier been declined the concession of regular bail by the learned Special Court as well as by this Court and even by the Hon'ble Supreme Court.
He has been receiving regular medical treatment while in judicial custody and has been repeatedly referred to GMCH, Sector 32, Chandigarh whenever required. The petitioner is under constant medical supervision of specialists and all necessary investigations and treatment are being provided by the jail authorities in consultation with Government doctors. Therefore, no exceptional circumstance exists warranting grant of interim bail merely on medical grounds. Hence, it is urged that the petition is liable to be dismissed. 5. This Court has heard the rival submissions. 6. The sole ground pressed by the petitioner for seeking interim bail is his alleged deteriorating medical condition. It is not in dispute that the petitioner is about 70 years of age and is suffering from certain age-related ailments. the medical record placed before this Court reveals that ever since his incarceration, the petitioner has been under constant medical supervision and has been repeatedly referred to the Government Medical College and Hospital, Sector- 32, Chandigarh for specialized consultation whenever considered necessary. The latest medical status report received from the Medical Superintendent, Model Jail, Chandigarh, along with the opinion of the doctors of GMCH, Sector-32, Chandigarh, assumes significance. The report demonstrates that the petitioner has been periodically examined by specialists in the Cardiology and Gastroenterology Departments. Although CT Coronary Angiography had initially been advised, the same was re-scheduled on more than one occasion owing to medical reasons and, eventually, the treating specialists found that the said investigation was not required/indicated. The petitioner thereafter continued to remain under regular follow-up in the Cardiology and Gastroenterology OPDs. His subsequent medical examinations, including the ECHO, were found to be within normal limits. The Gastroenterology Department has also recorded that the petitioner was doing better, had no active gastrointestinal complaints and was advised only to continue medical treatment with periodical review.
The latest report further records that the petitioner is doing well in jail and that his vital parameters, including blood pressure, are within normal limits. Thus, the apprehension sought to be projected by the petitioner that he is not receiving adequate medical treatment while in custody is not borne out from the medical record itself. Rather, the record reflects that the jail authorities have been vigilant in ensuring timely referrals of the petitioner to hospital as and when required. There is no medical opinion suggesting that the petitioner is suffering from any life-threatening emergency or that his treatment cannot be continued while he remains in judicial custody. In the considered opinion of this Court, the petitioner's medical condition is being adequately monitored by the jail authorities in consultation with specialists at GMCH, Sector-32, Chandigarh, and there is no exceptional circumstance warranting his release on interim bail at this stage. Consequently, finding no merit in the present petition, the same is dismissed. 7. However, it is clarified that the jail authorities shall continue to provide the petitioner with all requisite medical care and, if at any stage the treating doctors are of the opinion that any specialized investigation, hospitalization or procedure becomes necessary, the petitioner shall be referred to the appropriate Government medical institution without any delay. Needless to observe, in the event of any substantial change in the petitioner's medical condition, it shall be open to him to avail of such remedy as may be available to him in accordance with law. 20.07.2026
