1. Petitioners have filed this writ petition seeking following reliefs:-
“10.1That, the Hon'ble Court may kindly be pleased to quash the notice dated 29.09.2021 issued by the respondent no.2 with respect to the petitioners and further direct the respondent no. 2 & 3 not to disturb the possession of the petitioners and secure their right to enjoy over property under the scheme as stated above by permanently allotting houses to the petitioners as per possession over the houses. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent no.2 & 3 not to take any action either to evict the petitioners from the houses or forcing them to left their house as they are living and allotted houses after following due process of law. 10.3 That, the case of the petitioners is similar to petitioners in WP(C) no. 718/2021 and therefore seeking similar relief as granted by this Hon'ble Court. 10.4 Any other relief, which may be deemed fit and proper in the facts and circumstances of the case, may also be allowed.”

Learned counsel for respondents No.2 & 3 at the outset submits that according to his instructions, if the petitioners submits relevant documents showing their identity proof along with the requisite fees, the respondent No.2 will consider for allotment of the house possessed by the petitioners. 3

Learned counsel for the petitioners submits that the petitioners are working as labourers and therefore they may be granted at least six weeks time to make arrangement of the part of the fees required and to submit along with relevant documents with respondent No.2. He further submit that till that period, the interim protection granted to the petitioners be made effective. 4. On due consideration of submission of learned counsel for the respective parties, in particularly the submission made by learned counsel for respondents No.2 and 3 that the claim of the petitioners for allotment of the house will be considered upon petitioners depositing the relevant documents showing the identity proof and the requisite fees, this writ petition is disposed of directing the petitioners to submit the relevant documents giving proof of their identity and the requisite fees in full or in part within a period of two months and thereafter the respondent No.2 shall take decision within a further period of one month thereafter. For a period of four months, the interim order passed by this Court shall remain in force. Sd/- (Parth Prateem Sahu) Judge
