Grievance of the Petitioners seems to be the alleged decision on the part of the Respondent authorities in preparing the combined Gradation List of Lecturers and Headmasters. In the process, the Petitioners who are Headmasters have been pushed below the line in the order of seniority. 2. According to the Petitioners, they are Headmasters. In terms of the promotion rules governing the field, the next promotion is to the post of Principal. As per the rules, the said post is to be filled up by way of promotion from the feeder cadre of which 25% is reserved for Headmasters, 65% is reserved for Lecturers and 10% has to be filled up by way of direct recruitment. 3. The Petitioners now seem to be aggrieved by the provisional Gradation List issued by the Respondents showing the seniority of Headmasters as on 1.4.2022. Highlighting the said Gradation List, learned Counsel for Petitioners submits that the Gradation List includes the names of Lecturers as well and the Headmasters have gone below the line in the order of seniority. According to him, if this provisional list is acted upon then, in all probability, the Petitioners would not be entitled for promotion on the post of Headmaster from the 25% of posts which stands reserved to be filled up from the Headmasters. 4. Learned Counsel for Petitioners further submits that they have already raised a detailed representation/objection vide Annexure-P/6 dated 04.07.2023 with reminders also sent to the Respondent authorities, 3 however, till date no decision has been taken by the authorities concerned on the same. 5. The limited prayer made by the Petitioners as of now is that the Respondents may consider the representation/objection that the Petitioners have raised so far as the provisional Gradation List is concerned, i.e., Annexure P-1, dated 9.6.2023. 6. The limited prayer of the Petitioners is not opposed by learned State Counsel. However, he submits that decision would have to be taken keeping in view the rules governing the field. He also submits that grievance of some of the petitioners has already been redressed. 7. Having regard to the aforesaid submissions, the present Writ Petition is disposed of at this juncture, directing the Respondent No.2 to consider the objection/representation (Annexure-P/6) dated 04.07.2023 that the Petitioners have made in respect of the provisional Gradation List published and appropriate decision be taken before initiating any further promotion process for filling up of the post of Principal from the provisional Gradation List published on 09.06.2023 showing the combined seniority as on 1.4.2022. 8.
