2. Learned Senior Counsel Sri.G.L.Vishwanath appearing on behalf of Sri. Prakash Timmanna Hebbar, learned counsel for the petitioner submitted by inviting the attention of the court to the registered sale deed dated 15.07.2004 (Annexure-H )and submitted that the petitioner herein is claiming right over the property based on the registered sale deed and the said aspect has been properly considered by respondent No.6. 4. On careful consideration of the same would indicate that, the respondent No.6, after considering the registered sale deed dated 15.07.2004, has properly directed the revenue authorities to mutate the name of the petitioner based on the registered sale deed. However, on careful consideration of the Impugned order at Annexure - A would indicate that the respondent No.5 has taken into consideration the agreement of sale, but has ignored registered absolute sale deed dated 15.07.2004 (Annexure-H). In that view of the matter, as the petitioner herein had acquired the land in question based on the registered sale deed, I pass the following:
ORDER
i. The writ petition is allowed. ii. The findings recorded by respondent No.5 are hereby set aside.
Consequently, the endorsement dated 07.03.2013 (Annexure-V) issued by respondent No.6 is also set aside. Respondent No.4 is directed to mutate the name of the petitioner in the revenue records
