Learned advocate appearing for the petitioner submits that the subject matter of the present case relates to alleged recovery of 154 gams of yaba tablets. Petitioner is in custody for 7 months and although charges have been framed but witness action has not commenced.
Learned advocate appearing for the State opposes the prayer for bail in view of the quantum of seizure in the present case.
Having regard to the aforesaid, at this stage, I am not inclined to release the petitioner on bail. Petitioner be well advised to renew his prayer for bail after the evidence of the seizure list witnesses are over. Learned trial court would give priority to the seizure list witnesses and take steps so that the same is completed
2 at the earliest.
With the aforesaid observations, CRM(NDPS) 1536 of 2026 is dismissed at this stage.
Memo of Evidence submitted by the State be kept with the record.
