Learned advocate for the petitioner submits that there was a previous case of matrimonial dispute for which trial is continuing. Subsequently, again, the present petitioner being the brother-in-law has been foisted with the present criminal case with severe allegations. Mr. Krishnendu Bhattacharya, learned APP, appears for the State along with a junior of his choice as per the direction of this court. 2 regularized by the concerned authority. Learned advocate for the State opposes the prayer for anticipatory bail. I have taken into account the genesis of the present case including the attending materials. Having regard to the overall circumstances along with the medical report as also the fact that charge-sheet has already been submitted before the learned jurisdictional court, I am of the view that custodial detention of the present petitioner may not be warranted. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Saruk @ Saharukh Khan] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks. Accordingly, CRM (A) 1375 of 2026 is disposed of.
