1. Affidavit of service filed in Court today be kept with the records.
2. None appears on behalf of the respondents.
3. The petitioner retired from service on April 30, 2004 as an Associate Professor of Zoology (West Bengal Educational Service) from the Bidhannagar College.
4. His allegation is that his junior colleagues in the college received more salary than him. The petitioner has given details of the professors who are junior to him but received higher scale of pay.
5. The petitioner has submitted a representation before the Director of Public Instruction with request of revision of pay. Allegation is that the said representaion has not been considered by the authority.
6. As none is representing the respondents, accordingly, the Court is not in a position to decide the issue conclusively.
7. In view of the above, the instant writ petition stands disposed of by directing the Director of Public
2 Instruction to take a decision on the petitioner’s prayer for revision of his pay as has been done in case of the professors who are junior to him at the earliest, but positively within a period of twelve weeks from the date of communication of this order. If required, an opportunity of hearing may be provided to the petitioner for production of all documents in support of his claim.
8. A reasoned order shall be passed and communicated to the petitioner. If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the said authority without any delay.
9. Learned advocate for the petitioner is directed to forward a copy of the subject representation along with all other documents in support of his prayer to the aforesaid respondent at the time of communicating the order of the Court.
10. The writ petition stands disposed of.
11. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
12. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
