In Re: An application for Bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Polba Police Station Case No.163 of 2025 dated 12.05.2025 under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023;
Abhijit Sarkar @ Avijit Sarkar Versus The State of West Bengal
Mr. Santanu Talukdar Mr. Priyankar Ganguly Mr. Amaan Deep Gupta Ms. Pipasa Chakraborty. ...for the petitioner.
Mr. Rajendra Banerjee Mr. Amal Kumar Datta. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 2 months and due to grave and certain provocations the incident took place when he got the information relating to the deceased having a relationship with his wife.
Learned advocate for the State opposes the prayer for bail and submits that there are eyewitnesses and criminal antecedent of the petitioner.
So far as the issue relating to criminal antecedent is concerned, the same is a regular nature of offence under Sections 399/402 of the Indian Penal Code. So far as the present offence is concerned, the same emanates from a family dispute and issues
2 relating to the relationship.
Having considered the overall circumstances of the present case, I am of the opinion that further detention of the present petitioner is uncalled for as prosecution has relied upon 26 witnesses in order to prove its case as time will be required to take the trial to its logical conclusion. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner, namely, Abhijit Sarkar @ Avijit Sarkar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Chinsurah, Hooghly. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Hooghly without prior permission of the learned trial court.
Thus, CRM(M)1579 of 2026 is allowed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
