Versus The State of West Bengal Mr. Himangshu De Mr. Srinjan Ghosh. …for the petitioners. Mr. L. Vishal Kumar Mr. Sanjib Das. …for the State. Learned senior advocate appearing for the petitioners submits that the petitioners are in custody for 2 years 10 months and the alleged recovery in the present case is 24.420 kgs. of ganja. Learned advocate for the State opposes the prayer for bail as the trial is at an advanced stage and out of 17 witnesses 7 witnesses have been examined. State has submitted a report which reflects 6 witnesses have been examined and they propose to examine 8 witnesses. However, having regard to the quantum of seizure in the present case, the period of detention and the petitioners are ladies, I am inclined to release the petitioners on bail. Accordingly, the prayer for bail of the petitioners is 2 allowed. The petitioners, namely, Khateja Bibi and Doly Bibi shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act, 3rd Court, Asansol, Paschim Bardhaman. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Paschim Bardhaman without prior permission of the learned special court. Thus, CRM(NDPS) 1078 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
