1 CGHC010324192026 2026:CGHC:37646 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRCA No. 1385 of 2026 Dileshwar Patle S/o Risheshwar Patle Aged About 26 Years Resident Of Village Bandhwa, Police Station And Tahsil Lalpur, District Mungeli (C.G.) ...Applicant versus State Of Chhattisgarh Through- The Station House Officer, Police Of Police Station Civil Line, District Bilaspur (C.G.) ...Non-applicant For Applicant : Mr. Baldau Prasad Banjare , Advocate. For Non-Applicant/State : Ms. Ritika Verma, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 21.08.2026 1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 875/2026 registered at Police Station – Civil Line, District - Bilaspur (C.G.) for the offences punishable under Section 69 of the BNS. 2. The prosecution case, in brief, is that the victim lodged the FIR on 23.06.2026, stating that she had become acquainted with the VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.08.22 11:27:06 +0530 2 accused/applicant through Instagram about three years prior to the incident. Thereafter, they exchanged their mobile numbers, started communicating with each other and developed mutual liking. It is alleged that the victim had been residing in a rented accommodation at Sarju Bagicha Road for approximately three years. On 08.06.2023, the applicant allegedly visited her rented house and, on the pretext of marrying her and making her his wife, established physical relations with her. It is further alleged that thereafter, the applicant continued to visit her rented house and establish physical relations with her on several occasions. The victim has alleged that on 20.06.2026, the applicant established physical relations with her for the last time, but when she asked him to marry her, he refused to perform the marriage. Consequently, the victim lodged the present complaint against the applicant. Since the matter is sensitive in nature, a copy of the FIR has not been filed along with the present bail application. 3. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case and has neither committed nor participated in any act constituting the alleged offences. It is further submitted that the evidence collected by the prosecution does not disclose a prima facie case against the applicant. The victim is a major and married woman and, as reflected from her statement recorded under Section 180 of the BNSS in Crime No. 98/2026 registered at Police Station Lalpur, she has stated that she and the applicant were in a relationship for approximately four years, which according to the applicant indicates that the relationship was consensual. It is further submitted that prior to registration of the present FIR, the victim had lodged a written complaint at Police 3 Station Lalpur on 22.06.2026 at about 6:05 p.m., alleging that the incident had occurred on 20.06.2026 at about 8:00 p.m., on the basis of which Crime No. 98/2026 was registered for offences under Sections 296, 115(2), 351(3) and 3(5) of the BNS, whereas subsequently, on the basis of the same incident, another case bearing Crime No. 857/2026 was registered at Police Station Civil Lines, Bilaspur, under Section 69 of the BNS, and the registration of separate cases at two different police stations in respect of the same alleged incident raises serious questions regarding the prosecution version. It is also submitted that the police of Police Station Lalpur have already filed the charge-sheet on 08.07.2026, and therefore, custodial interrogation of the applicant is neither necessary nor justified. The applicant is ready and willing to furnish adequate surety and to abide by all the terms and conditions that may be imposed by this Hon'ble Court and, therefore, prays that he may kindly be released on bail. 4. On the other hand, the learned State Counsel appearing for the non- applicant/State, and submits that the applicant, on the pretext of marriage, had sexual relations with the victim, therefore, he is not entitled to the grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and the nature of the allegations levelled against the applicant, it appears that the victim, being a major, and the present applicant were known to each other and were in a consensual relationship, during which a physical relationship was established. Thereafter, when the relationship could 4 not culminate in marriage, the present FIR came to be lodged by the victim on the allegation that the applicant refused to marry her. Therefore, without making any further comments on the merits of the case, this Court is inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Dileshwar Patle, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) he shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha) CHIEF JUSTICE vaibhav
