Heard Ms. K. Tripti Rao, learned counsel for the petitioner as well as Mr. Nitansh Jaiswal, learned Deputy Government Advocate, 2 appearing for respondent No.1/State. 2. Petitioner has filed this petition under Section 528 of the BNSS, 2023 with following prayer: “It is therefore respectfully prayed that the Hon'ble Court may kindly be pleased to allow the instant petition and extend the time for compliance of order Dt. 05.01.2026 passed in CRMP No.3862 of 2025, in the interest of justice.” 3. Vide order dated 05.01.2026 in CRMP No.3862/2025, this Court has passed the following order/direction: “5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh with appropriate prayer and pleadings, subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today, and the same shall be transmitted to the Government School for Visual and Hearing Impaired, Tifra, District - Bilaspur (C.G.).” 4. Learned counsel for the petitioner submits that vide order dated 05.01.2026, the petitioner was directed to deposit a sum of Rs. 2,000/- before the Registry of this Court within a period of seven days, however, owing to certain unavoidable circumstances, the petitioner could not deposit the said amount within the stipulated period. The delay in compliance of order of this Court is neither deliberate nor intentional. 3 When the petitioner sought to deposit the said amount with a delay of one day, the Registry of this Court declined to accept the same on the ground that the period prescribed under the order had already expired. Hence, the petitioner has approached this Court seeking extension of time for compliance of the order dated 05.01.2026 passed in CRMP No. 3862/2025. 5. Learned State Counsel submits that he has no objection to the limited prayer made on behalf of the petitioner. 6. In view of above submissions, the instant petition is allowed and the petitioner is granted one week’s further time to comply with the order dated 05.01.2026 passed by this Court in CRMP No. 3862/2025.
