At the very outset, learned counsel appearing for the petitioner would submit that the petitioner was appointed to the post of Lower Division Teacher on 01.07.1989 at BALCO Shikshan Samiti, BALCO, Korba under respondent Nos. 3 and 4. He would contend that respondent No. 5, who is junior to the petitioner, having been appointed on 01.07.1993 to the post of Lower Division Teacher, has been granted promotion to the post of Upper Division Teacher on 01.09.2018. He would contend that respondent No. 5 is a near relative of respondent No. 3, therefore, he has been extended such benefit. He would pray to quash the order of promotion dated 01.09.2018. 2. On the other hand, learned State counsel would oppose the submission made by learned counsel for the petitioner. 3. Heard. 4. Having considered the facts narrated by learned counsel for the petitioner, this petition is disposed of reserving liberty in favour of the petitioner to make a detailed representation within a period of 30 days from today before respondent No.2 and in turn, the authority concerned is directed to conduct an enquiry and take an appropriate decision within a further period of 90 days. 5.
