The learned advocate representing the petitioner on instructions would submit that having regard to the fact that the appellate tribunal has now become functional, the petitioner would seek leave to withdraw the writ petition and such prayer is not opposed by Ms. Mukherjee, learned advocate representing the State. 2. Accordingly, Let this matter be dismissed as withdrawn with liberty to proceed before the appellate tribunal in accordance with law. If the appeal is filed within a period of 4 weeks from date, the appellate tribunal having regard to the peculiar facts and the observations made herein, shall hear out and dispose of the appeal on merits in accordance with law subject to compliance of other formalities. 3.
