The present petition has been filed under Section 483 of BNSS, 2023 (erstwhile Section 439 Cr.P.C.) seeking regular bail to the petitioner in case FIR No. 92 dated 13.08.2022, registered under Sections 419 IPC/319(2) BNS, 465 IPC/336(2) BNS, 468 IPC/336(3) BNS, 471 IPC/340(2) BNS, 120-B IPC/61(2) BNS at Police Station Mullanpur Garibdas, District S.A.S Nagar Mohali. 2. The case of the prosecution is that the FIR was registered on the complaint of Lt. Col. Pawan Kumar Saran, who had earlier lodged a police complaint and a private complaint under Section 200 Cr.P.C. During the inquiry, it was further found that summons issued by the Court in maintenance proceedings were allegedly received and acknowledged by Balkar Singh, who impersonated the complainant, with the active involvement of Abhishek Saran, thereby the instant FIR has been registered. 3. Learned counsel for the petitioner submits that the co-accused Balkar Singh has already been granted bail by this Court, vide order dated 10.04.2023 in CRM-M No14950 of 2023 (Annexure P-5). It is further submitted that the petitioner is in custody for the last 01 month and 26 days. He, therefore, prays for release of the petitioner on regular bail. 4. Notice of motion. 5. On the asking of the Court, Mr. Subhash Godara, Addl. AG, Punjab, accepts notice on behalf of the respondent and vehemently opposes the prayer for grant of regular bail to the petitioner. He has filed the custody certificate of the petitioner which is taken on the record. As per the custody certificate, the petitioner is in custody for the last 01 month and 26 days. 6. Mr. Ajit Singh, Advocate, puts in appearance on behalf of the complainant and has filed Vakalatnama, which is taken on the record. He also opposed the grant of bail while submitting that the allegations against the petitioner are serious in nature. 7. I have heard the learned counsel for the parties and perused the record. In view of the above submissions of learned counsel for the parties and keeping in view the facts that the petitioner is in custody for the last more than 01 month and 26 days and that the trial is likely to take a long time to conclude, therefore, this Court deems it appropriate to grant the concession of regular bail to the petitioner during the pendency of the trial as the continuous detention of the petitioner would not serve the ends of justice. 9. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 10. However, it is made clear that in case the petitioner misuses the concession of bail, the State/complainant would be at liberty to seek cancellation of his bail.
