This is an application seeking expeditious hearing of G.R. No. 2059 of 2023, arising out of Jagaddal Police Station Case No. 94 of 2023, dated March 11, 2023, registered under Sections 420, 419, 468, 467, and 120B of the Indian Penal Code, pending before the learned Judicial Magistrate, 2nd Court, Barrackpore, North 24 Parganas. Learned advocate appearing for the petitioner submits that the matter was last taken up for hearing on July 23, 2026, when the learned Magistrate in the Court below was pleased to fix February 24, 2027, as the next date for consideration of charge. It is submitted that the learned Magistrate in the Court below ought not to have fixed the next date of hearing after such a long interval. It appears, however, that the regular Presiding Officer of the Court was absent on July 23, 2026, which possibly prompted the
2 learned Magistrate-in-Charge to fix the next date of hearing on February 24, 2027. Having regard to the fact that the petitioner is a senior citizen, this application is disposed of by granting liberty to the petitioner to make an appropriate application before the learned regular Presiding Officer of the Court, upon his/her resuming charge, seeking expeditious hearing of the case. Upon such an application being filed, the learned regular Presiding Officer shall endeavour to conclude the hearing on charge within a period of two months from the date of filing of such application. With the aforesaid directions, CRR 2737 of 2026 stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
