instance of Balkar Singh with the allegations that two unknown persons had fired 7-8 shots towards his house and he suspected that the same was done at the instance of Jatinder Singh (petitioner). The copy of the FIR is as under:-
“Statement by Balkar Singh son of Sawinder Singh, resident of village Talwandi Dasodha Singh, Police Station Kathunangal, age about 38 years, mobile number 98149-71312, stated that I am a resident of the above address and do agricultural work. My residence is outside the village on Sohnia Kuhara Road. We were 2 brothers and my elder brother Avtar Singh died about 2 years ago. On 20-3- 2025 at around 10:55 PM, at night, I was sleeping in my room with my family when suddenly I heard a loud noise outside. So I came out of my residential room and saw that outside the rear glass of the vehicle number PB08-CA- 1313, brand Swift, white in colour, parked in the veranda was broken and we looked outside the main gate of the house, but no one was seen outside the house and there were signs of a bullet marks at our main gate.
Later, when I checked the CCTV cameras installed in my house, I saw, 2 young men on a motorcycle, one of whom had covered his face with a cloth and the other young man had his face uncovered and who got off the motorcycle and came towards the house. The young men fired about 7-8 shots with their pistols at the main gate outside our house and after firing, the young men rode on their motorcycles and went away. Till now, I have been searching for these people on my own. I suspect that this act was done by the Sarpanch of my village, Jatinder Singh, son of Unkar Singh, resident of Talwandi Dasandha Singh, because on 07- 03-25 in the evening, Jatinder Singh, Sarpanch, son of Unkar Singh, resident of Talwandi Dasandha Singh, had threatened me that he would come at me, which is why today I, along with my uncle (chacha), Amrik Singh, son of Rattan Singh, resident of KUSUM 2026.05.01 12:52 I attest to the accuracy and integrity of this document PHHC Chandigarh

7. Both sides sought the concession of anticipatory bail and the same has been granted to all the accused except the petitioner in FIR No.90 dated 07.07.2025 and all the accused in DDR No.3 dated 15.12.2025. 8. all the above persons surrounded our car and started pushing us, then I was making video of this incident with my phone. Then Jatinder Singh Sarpanch and Kultawar singh above tried to snatch my I-phone but I pulled my phone forcibly inside the car. I was sitting on the backseat of my car.
Then meanwhile, Kultawar Singh @ Toni caught my neck and snatched my 3-tola gold chain forcibly and Joti s/o Avtar Singh above snatched my original spectacles of Guji Company and then I put upside backside glass of my car and when in order to save our lives, we tried to run away our car, then Jatinder Singh Sarpanch above and Kultawar Singh @ Toni above taken out the turban of my husband from his head and pushed his hairs and while going in the car, they also took away turban of my husband. Then in order to save our lives, by running our above car, we were coming towards the side of Kathunangal, then Jatinder Singh Sarpanch above and his fellow persons followed us in their cars with the intention to kill us. 9.
A cross version has been registered against the present complainant party under Sections 3 of the SC/ST (Prevention of Atrocities) Act, 1986 and Sections 115(2), 191(3) and 190 of BNS, 2023 and their anticipatory bail applications stand dismissed by a Co-ordinate Bench of this Court vide order dated 06.04.2026. 10. It is relevant to mention here that, for certain inexplicable reasons, the petitioner was exonerated in the above case as well. This Court was shown a mobile phone recording of the occurrence. The said recording was also shown to the SSP concerned, who on examination of the same, has renominated the present petitioner as an accused, in FIR No.180 dated 14.12.2025 vide GD No.41 dated 23.04.2026. 11. The learned counsel for the petitioner contends that it is a case of version and cross-version. All the accused from both sides have been granted the concession of anticipatory bail by this Court and the petitioner is entitled to the similar concession. He contends that in FIR No.26 dated 21.03.2025, the petitioner was never actually an accused. In fact, in that case the complainant namely Balkar Singh, has given a supplementary statement exonerating the petitioner. Despite the said fact, the bail application of the petitioner was dismissed as the investigating agency did not bring it to the notice of the Court that the petitioner had been exonerated. Therefore, mere registration of FIR No.26 dated 21.03.2025 cannot lead to the assumption that the petitioner is a habitual offender or that his present bail application is liable to be dismissed on account of his criminal antecedents. CRM-M-3739-2026 12
As regards FIR No.180 dated 14.12.2025, he contends that the occurrence took place during the course of the elections. The complainant party had no reason to be present at the spot. The mobile phone recording does not further the prosecution case qua the allegations in FIR No.180.
Be that as it may, a cross version of the said FIR stands registered bearing DDR No.3 dated 15.12.2025 under Sections 115(2), 191(3), 190 BNS, 2023 and Section 3 of SC/ST (Prevention of Atrocities) Act. 1989, in which the bail application of the present complainant-Jagdeep Kaur Grewal and others stands dismissed by a Co-ordinate Bench of this Court vide order dated
06.04.2026. Therefore, the registration of FIR No.180 also does not, in any manner, establish that the petitioner is a serial offender thereby disentitling him to the concession of bail in the FIR in question i.e. FIR No.90 dated
07.07.2025. He, thus, prays that the petitioner be granted the concession of anticipatory bail in the above facts and circumstances. 12. The learned counsel for the complainant party, on the other hand, contends that the petitioner is a habitual offender. He was duly named as an accused in FIR No.26 dated 21.03.2025 under Sections 125, 3(5) BNS and Sections 25/27 Arms Act. In fact, the DGP, Punjab has filed an affidavit in CRWP No. 7634 of 2025 stating that the petitioner was an accused. His bail application stands dismissed. Later, he has been exonerated without any basis whatsoever. He contends that in the present case, the complainant, who is an Advocate by profession and doing her duty as such towards her client KUSUM 2026.05.01 12:52 I attest to the accuracy and integrity of this document PHHC Chandigarh
CRM-M-3739-2026 13
Balkar Singh, has been attacked not only on 07.07.2025 leading to the registration of FIR No.90, but even thereafter, during the elections held on 14.12.2025, wherein she and her family members have been attacked for the second time. In fact, the petitioner belongs to the ruling dispensation, because of which the complainant party is being repeatedly attacked and false cross versions are being recorded, wherein the complainant party is made an accused. He contends that the investigating agency is hand in glove with the petitioner.
In fact, the allegations levelled in the FIR and his antecedents do not entitle him to the concession of anticipatory bail particularly when an Advocate is being repeatedly targeted for representing a client. 13. The learned State counsel, on the other hand, contends that the petitioner was never nominated as an accused in FIR No.26 dated 21.03.2025, though he was named therein on suspicion. While admitting that the bail application of the petitioner was dismissed by a Co-ordinate Bench of this Court on 10.07.2025, he contends that as the petitioner was not nominated as an accused, he was not required to be arrested despite his bail application having been dismissed. As regards FIR No.90, i.e. the present case, he contends that the petitioner has joined investigation. It is a case of version and cross-version and therefore, his custodial interrogation is not required. As regards FIR No.180, he contends that the SSP concerned has renominated the petitioner as an accused, on an examination of the mobile KUSUM 2026.05.01 12:52 I attest to the accuracy and integrity of this document PHHC Chandigarh
CRM-M-3739-2026 14
phone recording of the occurrence. He, thus, contends that the petitioner be granted the concession of anticipatory bail in the present case. 14. I have learned counsels for the parties. 15. A perusal of FIR No.26 dated 21.03.2025 would reveal that the petitioner is named on suspicion. It is indeed strange that his bail application was vehemently opposed by the State and came to be dismissed by a Co- ordinate Bench of this Court vide order dated 10.07.2025, and he has still not been arrested despite the dismissal of the bail application, on the grounds that he was never an accused. The petitioner and his co-accused have attacked the complainant-Jagdeep Kaur Grewal, an Advocate representing Balkar Singh, along with her family members on 07.07.2025 leading to the registration of an FIR No.90. Though, a cross version had been registered, the fact remains that the complainant and her house was fired upon leading to gun shot injuries on the person of Harpal Singh, Mandeep Singh and Yoga Singh.
Once again on 14.12.2025, the complainant and her family members have been attacked during the course of elections. Again, the petitioner was exonerated but has been renominated only when this Court examined the mobile phone recording of the occurrence and asked the SSP concerned to do the same. 16. Apparently, the petitioner, who is a Sarpanch of the village, appears to be extremely well-connected as he is repeatedly being exonerated at the instance of the investigating agency. It is indeed unfortunate that a lady, who is performing her duty as an Advocate, has been threatened and KUSUM 2026.05.01 12:52 I attest to the accuracy and integrity of this document PHHC Chandigarh
CRM-M-3739-2026 15
intimidated at the instance of the petitioner for merely performing her professional duties and nothing more. This kind of conduct cannot be condoned. To punish the Advocate for representing her client is to silence the law itself. 17. In view the seriousness of the allegations levelled against the petitioner as also the requirement for his custodial interrogation to effect the recovery of the weapon and to take the investigation to its logical conclusion, the question of grant of anticipatory bail does not arise and the present petition stands dismissed. 18. All the pending miscellaneous applications, if any, stand
disposed of.
