Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Sunil Gupta, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that there has been no recovery from the present petitioner and the subject matter of the present case relates to alleged recovery of 50 bottles of phensedyl from a different accused. Petitioner is in custody for a period of six months, as such, prays for bail. Learned advocate for the State opposes the prayer for bail and submits that there is a similar case pending against the present petitioner. 2 I have taken into account the merits of the present case which is on the basis of the statement of co-accused. Having regard to the same, I am of the opinion that the petitioner be released on bail on stringent conditions. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Amirul Sk. @ Amirul Sekh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, both of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1057 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
