Learned counsel for the petitioner submits that the present writ petition has been :led questioning the order of deputation dated 19.01.2026 (Annexure P/5), by which the respondent No. 7 has been sent on deputation on the post of Assistant Manager at Drug Ware House Kabirdham by the State of Chhattisgarh. The main ground to question the order of deputation of respondent No. 7 is that, the petitioner was
3 posted on deputation on the same place by order Annexure P/3 dated 28.06.2024 for a period of two years. But before expiry of the two years period, the order of deputation as far as respondent no. 7 is concerned has been passed by placing the respondent No. 7 in the present place of posting of the petitioner. Learned counsel for the petitioner submits that as the period of two years was not expired when impugned
order Annexure P/5 has been issued by the State Government, the same is bad in law and contrary to the order of deputation, by which the petitioner is still working in the said place.

Learned counsel for the respondents submits that by interim
order dated 31.01.2026 passed by this Court, the petitioner is still continuing in the place of posting on deputation i.e. Drug Warhouse Kabirdham as Assistant Manager. Hence the writ petition be disposed of with a liberty to the State to pass a fresh order as the period of two years of deputation has already been expired.
3. I have heard learned counsel for the parties and perused the pleadings and documents appended thereto.

Considering the submission made by the learned counsel for the respondents that the petitioner has been permitted to render the services as Assistant Manager in Drug Warehouse Kabirdham on the strength of the interim order passed by this Court and now the period of the deputation of the petitioner has already been expired, without expressing any opinion on the merits of the case, the present petition is disposed of reserving liberty in favour of the respondents to pass a fresh
order in respect of posting of the petitioner, as well as respondent No. 7, if administrative exigency arises. Sd/-
