Chakraborty …for the petitioner Mr. Shyanti Poddar ..for the State Learned advocate appearing on behalf of the petitioner submits that the petitioner has been unnecessarily detained behind the bars as there is no possibility of the trial concluding in near future. The accusation against the petitioner is the alleged recovery of 429 grams of morphine. Till date, only one witness has been examined and the prosecution has relied upon 14 witnesses in order to prosecution the case. Learned advocate appearing on behalf of the State submits that recovery was from the present petitioner. Having regard to the stage of the proceeding, I am of the opinion the petitioner be well advised opposed this Court after the evidence of the seizure list witnesses over especially the independent witnesses. Accordingly, CRM (NDPS) 1497 of 2026 is dismissed. Report filed by the State be kept with the record. 2 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
