ORAL ORDER
1. Accused No.1 in Crime No.188/2026 registered by Chitradurga Rural Police Station, Chitradurga, for the offences punishable under Sections 311 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.188/2026 was registered by Chitradurga Rural Police Station, Chitradurga, against three unknown persons initially for the offences punishable under Sections 309(6) read with Section 3(5) of BNS, 2023, based on the first information dated 02.05.2026 received from Ramesh R, S/o Rajappa. During the course of investigation, petitioner was arrested on 02.05.2026 and remanded to judicial custody. Investigation of the case is completed and charge sheet has been filed. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.491/2026 was rejected on 21.05.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that FIR in the present case was registered against unknown persons on 02.05.2026 at about 13.00 hours.
In the first information, it is

alleged that on 30.04.2026 at about 01.30 p.m., three unknown persons had boarded the autorikshaw of the first informant and after traveling to some distance, they allegedly had pulled him out of the autorikshaw, snatched a sum of Rs.10,000/- from his pocket and also his mobile phone and thereafter, assaulted him. First information in respect of the alleged incident that had taken place on 30.04.2026 at about 14.00 hours was submitted on 02.05.2026 at about 13.00 hours, which is after a delay of nearly two days. Material on record would go to show that first informant, who is the injured in the present case was admitted in the Hospital and charge sheet material does not reveal that a medico legal case was registered. 5. Be that as it may, the fact remains that petitioner herein has no other criminal antecedents. Investigation of the case is now completed and charge sheet has been filed. Amount of Rs.10,000/- belonging to the victim and also his mobile phone has been recovered in the present case during the course of investigation. The alleged offences are not punishable exclusively with death or life imprisonment. Under the circumstances, I am of the opinion that the prayer made by the petitioner, who has no other criminal antecedents, for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-

6. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.188/2026 registered by Chitradurga Rural Police Station, Chitradurga, for the offences punishable under Sections 311 read with 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
