Tapasi Palit Sinha, Adv. Suman Chattopadhyay, …for the State. Affidavit of service filed by the petitioner is taken on record. The petitioner is the Shabhapati of Manikchak Panchayat Samity and seeks a stay of the meeting called by the Prescribed Authority pursuant to a no confidence motion submitted before the said authority for her removal. Learned counsel for the petitioner submits that the petitioner apprehends breach of peace if the said meeting is held. It appears that a no confidence motion has been submitted by the members of the Panchayat samity for removal of the petitioner before the Prescribed Authority on 14th July, 2026. By a notice issued on 23rd July, 2026, the Prescribed Authority fixed the meeting on 31st July, 2026. The meeting has been fixed in terms of Sections 101(3) and 101(4) of The West Bengal Panchayat Act, 1973. There is no illegality or irregularity in either the motion or the notice that calls for interference by this Court. Since the petitioner apprehends breach of peace at the meeting, the Officer in charge, Manikchak Police Station, being the 9th respondent herein, is directed to render necessary 2 assistance to the Prescribed Authority so that the meeting fixed on 31st July, 2026 is held peacefully without any disturbance from any corner whatsoever. The writ petition is devoid of any merit and is accordingly dismissed. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
