IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.325 of 2026 Pinku @ Sangram Keshari Sahoo @ Sangram Sahoo …. Petitioner Ms. R. Biswal, Advocate -Versus- State of Orissa …. Opposite Party Mrs. S. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 19.01.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Banarpal P.S. Case No.671 of 2025 corresponding to G.R. Case No.1359 of 2025 pending in the court of learned J.M.F.C., Banarpal on the grounds stated. 3. From the FIR as at Annexure-1, the Court finds that two other accused persons named therein were found preparing spurious foreign liquor for selling it to general public and recovery and seizure said to have been made by the local police. The allegation against the petitioner as made to reveal from Annexure-1 is that he supplied the raw materials to the co-accused persons. According to learned counsel for the State, the petitioner is also responsible and that for his involvement, spurious foreign liquor was prepared by the co-accused persons. In course of integration, the accused persons arrested at the spot disclosed the name of the petitioner with the claim of the latter’s supply of the raw materials for manufacture of foreign liquor. Considering the confessional statement of the co-accused persons and disclosure of the name of the petitioner, for which, he apprehends arrest in the hands of the local police and the role played by him and the fact that he is not alleged to be responsible for the manufacture spurious foreign liquor, rather, two other accused persons were involved in such manufacture, this Court though not inclined to grant him pre- arrest bail, however, is of the view that he should be directed to surrender and released on bail with suitable conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioner surrenders before learned J.M.F.C., Banarpal in connection with Banarpal P.S. Case No.671 of 2025 corresponding to G.R. Case No.1359 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with one solvent surety for the like amount with such other conditions imposed. The above order shall not be given effect to if the petitioner is found to have more than two antecedents in Banarpal P.S. Case No.15 of 2025 and Angul P.S. Case No.944 of 2025 with an additional condition that he shall attend the PS once in a fortnight for the purpose of investigation and to co-operate the IO in that regard and to submit an undertaking that he shall be involved in any such nefarious activities after being released. 6.
